EEOC Settles Discrimination Claims With San Diego Temporary Staffing Firm

Oct. 22 –A San Diego-based staffing company has agreed to pay $920,000 to settle charges filed by the Equal Employment Opportunity Commission that the firm engaged in a pattern and practice of classifying and failing to refer job applicants in San Diego based on their race, color, sex, national origin, age or disability, the EEOC said in a statement.
The settlement, announced Oct. 22 between the EEOC and both Huyssen Inc., which was licensed to use the registered service mark Sedona Staffing, and Sedona Group, is part of a five-year conciliation agreement that also includes Huyssen’s agreement to implement preventive measures, including diversity training to all employees at its San Diego location, and the hiring of an independent EEO consultant.
It resolves six EEOC discrimination charges filed between 2007 and 2009. Those charges were resolved during the EEOC’s administrative process, so no case was ever filed in court, EEOC Program Analyst Christine Park-Gonzalez told Bloomberg BNA Oct. 22.
Neither Huyssen nor Sedona Group admitted liability in the settlement agreement.
The settlement includes a class fund for currently unidentified victims who suffered from the alleged discrimination. Potential claimants will include men and women of various races and national origins, individuals 40 years of age or older, and those with disabilities, who applied for referral employment through Huyssen of San Diego between March 1, 2007, and May 31, 2008, the EEOC said.
Over the next four months, the claims administrator will issue claims packets to potential claimants.
In response to a Bloomberg BNA query, Park-Gonzalez said there are believed to be roughly 200 potential claimants.
Websites for both Sedona Group and Sedona Staffing list the same phone number in San Diego. Carla Stanley, listed as president of Sedona Staffing, did not return phone calls to her office and mobile phone seeking comment.
