Should Rajat Gupta Take The Stand?
May 31 (Bloomberg Law) — Richard Holwell, founding partner at Holwell Shuster & Goldberg LLP, talks with Bloomberg Law’s Lee Pacchia about whether Goldman Sachs board member Rajat Gupta should take the witness stand in his own defense at his trial for insider trading. Prior to leaving the bench, Richard presided in Manhattan federal court over the insider trading trial of Galleon Group co-founder Raj Rajaratnam. Richard notes that the decision on whether or not clients should take the stand is one of the most difficult choices facing criminal defense attorneys and that he has rarely seen defendants doing so help their case. Richard also comments on whether Rajaratnam could have avoided conviction if he took the stand in his own trial.
